EU Battery Passport: The Complete February 2027 Compliance Guide

From 18 February 2027, every electric vehicle (EV) battery, every light means of transport (LMT) battery, and every industrial battery above 2 kWh placed on the EU market must carry a battery passport - a digital record accessed through a QR code on the battery, containing its carbon footprint, material composition, recycled content, performance data, and supply chain due diligence. The battery passport, established by Article 77 of Regulation (EU) 2023/1542, is the first mandatory Digital Product Passport under EU law. Batteries in scope that are placed on the market after the deadline without one cannot legally be sold in the European Union.
That deadline is now under six months away. This guide covers exactly what the regulation requires, who it hits, and how to get compliant without an enterprise budget.
What Is the EU Battery Passport?
The battery passport is a digital record tied to an individual battery model - and for many data points, to the individual battery unit. It is accessed by scanning a QR code physically present on the battery, which resolves the battery's unique identifier and opens its passport data.
It was created by the EU Battery Regulation (EU) 2023/1542, which entered into force on 17 August 2023 and replaced the old Battery Directive 2006/66/EC. The regulation governs the full battery lifecycle: raw material extraction, manufacturing, use, repurposing, and recycling. The passport is the mechanism that makes all of it visible.
Two things make it historically significant:
- It is the first mandatory Digital Product Passport under EU law. Everything the ESPR will later require for textiles, electronics, and furniture is being tested on batteries first.
- It is unit-level, not just model-level. Unlike most product compliance, the passport follows each individual battery through its life - including repurposing and second-life use, where responsibility for updating the passport transfers to the operator putting the battery back on the market.
Which Batteries Need a Passport - and Which Don't
The passport requirement applies to three categories from 18 February 2027:

Portable and SLI batteries are exempt from the passport itself, but they are not exempt from the regulation - labelling, recycled content, and collection obligations still apply.
One edge case worth knowing: a battery that was on the market before the deadline can stay in circulation without a passport. But if it is withdrawn and reintroduced - after repurposing, remanufacturing, or a change of ownership that counts as placing on the market - a passport becomes mandatory, and the operator doing the reintroducing owns that obligation.
The 18 February 2027 Deadline Has No Grace Period
Article 77 is unambiguous: from 18 February 2027, each in-scope battery "placed on the market or put into service" shall have a battery passport. There is no transition window for newly placed batteries, no small-manufacturer exemption, and no phased start within the covered categories.
Six months sounds manageable until you look at what a passport actually requires. Most of the data - carbon footprint per kWh, recycled content shares, due diligence documentation - lives with your suppliers, not with you. Collecting, verifying, and structuring it is a supply chain project, not an IT ticket.
What the Battery Passport Must Contain
Annex XIII of the regulation defines the contents. In 2026, the European Commission published guidance for implementation that enumerates 71 data points, with mandatory counts per category at the February 2027 deadline:
- EV batteries: 51 mandatory data points
- LMT batteries: 54 mandatory data points
- Industrial batteries above 2 kWh: 36 mandatory data points
Grouped by subject, the passport covers:
General information. Battery unique identifier, manufacturer identity and contact details, manufacturing date and place, battery category, weight, chemistry, and cell type.
Carbon footprint. The carbon footprint of battery manufacturing in kg CO2e per kWh, the performance class, the calculation methodology, and a link to the supporting study. This connects to the regulation's Article 7 carbon footprint declarations, which are being phased in through delegated acts.
Supply chain due diligence. The due diligence policy applied to raw materials - cobalt, lithium, nickel, and natural graphite - plus third-party verification results where applicable.
Material composition. Cathode, anode, and electrolyte chemistry; hazardous substances with identity, concentration, and location in the battery; critical raw materials; and the recycled content share for cobalt, lead, lithium, and nickel.
Performance and durability. Rated capacity and energy, voltage range, expected lifetime in cycles and calendar years, state-of-health indicators, temperature range, charge rate, round-trip efficiency, and internal resistance.
End-of-life information. Dismantling and safety instructions, collection and take-back scheme details, and suitability for repurposing or second-life applications.
Not everyone sees everything. Annex XIII is organized as access tiers: some data is public to anyone who scans the QR code, some is restricted to parties with a legitimate interest (such as repairers, refurbishers, and recyclers), and some is reserved for notified bodies, market surveillance authorities, and the Commission. Your passport system needs role-based access, not a single public page.
Who Is Legally Responsible
The obligation sits with the economic operator placing the battery on the EU market:
- For EU-manufactured batteries: the manufacturer.
- For imported batteries: the importer - and if there is no importer fulfilling the role, the distributor.
This matters for non-EU manufacturers in particular. If you make batteries or battery-containing vehicles outside the EU, your EU importer is legally on the hook for the passport, which means your importer will be asking you for the data. Brands that answer that request slowly will lose shelf space to brands that answer it fast.
How the Passport Is Delivered: QR Code, Unique Identifier, Registry
The technical delivery model has three parts:
- A QR code on the battery. The regulation mandates the QR code as the physical data carrier. It must remain legible and accessible - which is why placement and print durability are real design decisions, not afterthoughts.
- A unique identifier. The QR resolves to the battery's unique ID, which links the physical unit to its passport record.
- A central registry. Passports must connect to the EU's central battery registry, which the Commission has been standing up ahead of the deadline, so market surveillance authorities can verify conformity.
In practice, this means your passport platform needs to generate standards-compliant identifiers, host the data with the correct access tiers, keep records available for the battery's full lifetime (including after you stop selling that model), and handle updates when batteries are repurposed.
Related Obligations Arriving on the Same Clock
The passport does not exist alone. The same regulation phases in:
- Carbon footprint declarations for EV and industrial batteries, with performance classes and eventually maximum thresholds to follow.
- Recycled content minimums for cobalt, lead, lithium, and nickel from 2031, with declaration requirements arriving earlier.
- Supply chain due diligence obligations for companies above the turnover threshold, covering cobalt, lithium, nickel, and natural graphite.
The passport is where much of this data becomes visible to the market. Treating it as a standalone compliance artifact misses the point - it is the publishing layer for obligations you already have.
What Non-Compliance Costs
There is no EU-wide fine schedule - penalties are set by member states, and the regulation requires them to be effective, proportionate, and dissuasive. The real enforcement mechanism is simpler and harder: a battery without a compliant passport fails its conformity assessment and cannot be legally placed on the market. Market surveillance authorities can order withdrawals, and customs can block imports at the border.
For an EV or energy storage manufacturer, that is not a fine. That is revenue stopped at the border.
How to Prepare: A Five-Step Checklist
1. Map your scope. List every battery you place on the EU market by category. Anything EV, LMT, or industrial above 2 kWh needs a passport from February 2027.
2. Gap-check your data against the 71 data points. Pull the Commission's guidance document and mark, for each mandatory data point in your category: have it, can get it, or nobody in the company knows where it is. The third column is your project plan.
3. Chase supplier data now. Carbon footprint per kWh, recycled content shares, and due diligence documentation come from cell and material suppliers. These requests take months, not weeks.

5. Pilot before the deadline. Pick one battery line, generate its passport, test the QR flow with your own team and one friendly customer, and fix what breaks. February 2027 is a bad time to discover your data model is wrong.
The Opportunity: One QR Code, Two Audiences
Here is what the compliance-only reading of the battery passport misses: the same QR code that serves regulators can serve your customers.
A QR code on a battery or a battery-powered product is a permanent, physical entry point to a digital relationship. The scan that a market surveillance officer uses to check conformity is the same scan an end customer uses to get setup instructions, register their warranty, ask an AI assistant a troubleshooting question, or order accessories.
