Digital Product Passports and digital instructions for toy brands.

It is a set of data specific to a toy model, required by the EU Toy Safety Regulation (EU) 2025/2509. It shows the toy complies with EU law and is reached through a data carrier on the toy, its label, packaging or documentation. It replaces the EU declaration of conformity and must stay available for 10 years after the toy is placed on the market.

Regulation (EU) 2025/2509 was published in the Official Journal on 12 December 2025, entered into force on 1 January 2026 and applies from 1 August 2030. It replaces the Toy Safety Directive 2009/48/EC. Toys placed on the market under the old Directive before 1 August 2030 may still be sold after that date.

Yes. Under the new regulation, the digital product passport replaces the EU declaration of conformity that Directive 2009/48/EC required. Where other EU law applies to the toy, such as radio equipment or electromagnetic compatibility rules, the DPP can also serve as the declaration of conformity under that law.

The manufacturer creates it before placing the toy on the market, and by doing so takes responsibility for the toy’s compliance. The DPP corresponds to a toy model, not to each individual item, and must be accurate, complete and kept up to date.

Annex VI Part I lists the mandatory data. It includes the unique product identifier, manufacturer and EU responsible operator details, a colour image of the toy, the EU laws and standards applied, the notified body where applicable, the CE marking, allergenic fragrances subject to labelling and a consumer communication channel. Safety warnings and instructions for use are optional additions.

The regulation requires a data carrier, not specifically a QR code. The European Commission says consumers can reach the DPP “via a QR code or other data carrier”, and the exact carrier, layout and positioning will be set by a delegated act. The carrier goes on the toy or an affixed label, or on the packaging or documentation if the toy’s size or nature doesn’t allow it, and must be visible before purchase, including online.

They can be added to the DPP, but not instead of the physical versions. Warnings must still appear on the toy, an affixed label or the packaging and be visible before purchase, and instructions and safety information must accompany the toy. A digital version adds translations, video and updates on top of what is printed.

Whoever declares a toy for release into the EU must give customs the unique registration identifier the EU registry issued for it. Customs may release the toy only after an automatic check that the identifier and commodity code match the registry. Release is not proof of compliance, and market surveillance authorities still carry out their own checks.

Yes. Before placing a toy on the market, the manufacturer must create the DPP, affix the data carrier and affix the CE marking. The CE marking is also part of the mandatory DPP contents.

In the US, a Children’s Product Certificate (CPC) is a written certificate from the manufacturer or importer that a product for children aged 12 and under meets the applicable CPSC rules. For toys that includes ASTM F963, mandatory under 16 CFR part 1250, and the certificate must be based on testing by a CPSC-accepted third-party lab. Since 8 July 2026, importers must eFile CPC data at entry.
